  • Pension Credit(s) for Vesting

A Participant who was a member of Operating Engineers Local 428 for whom contributions were made on their behalf to the Local 428 Annuity Trust Fund before November 30, 2024 shall receive the same amount of Pension Credits in this Plan, with a maximum amount of four (4) Pension Credits. These Pension Credits are subject to the participant accruing one (1) Pension Credit with this Plan.

NOTE: For our Plan, Pension Credits obtained from contributions to the Local 428 Annuity Trust Fund are to be used ONLY for vesting purposes in our Plan and are subject to Operating Engineers Pension Trust Plan Rules. These credits are not to be used towards calculating amounts for pension benefits, lump sum benefits, or death benefits.

  • Participation/Breaks in Employment

  • Participation

Participation in the Plan starts when the employee is first reported to the Trust as an employee and contributions are made to the Trust on his behalf.

  • Break in Employment

An Employee incurs a Break in Employment in a Plan Year if the Employee fails to complete 500 or more Hours in a period of three consecutive Plan Years.
Your pension will then be calculated using the Pension Factors in effect at the time of the Break rather than the Pension Factors in effect when you retire.
